Terms of service

1 oct. 2026

Article 1 - Seller and scope

1.1 Seller. The website https://lebaralunettes-shop.com (the "Website") is operated by LE BAR A LUNETTES SRL, Rue du Mouton-Blanc 15, 4000 Liège, Belgium, company number (BCE/KBO) 0704.932.157, VAT BE 0704.932.157, RLE Liège, Liège division ("Le Bar à Lunettes", "we", "us"). Contact: contact@lebaralunettes-shop.com – +32 4 234 03 83

1.2 Scope. These Terms & Conditions of Sale (the "Terms") apply to all orders placed on the Website. They form a whole with our Return & Refund Policy, our Privacy Policy and the information given on the product pages and at checkout. Sales made in our Liège boutique are not governed by these Terms.

1.3 Acceptance and applicable version. By placing an order, you confirm that you have read and accepted these Terms. We may update them at any time; the version that applies to your order is the one published on the Website on the date of your order. You can download or print them at any time.

1.4 Customers. The Website is intended for adults with full legal capacity. Some provisions, including the right of withdrawal, apply only to consumers, meaning individuals acting for purposes outside their trade, business or profession. Professional buyers, including opticians, retailers and resellers, are not entitled to them.

1.5 Language. These Terms are available in English. Where they are also published in another language, the English version prevails, unless mandatory law in your country provides otherwise.

Article 2 - Products and availability

2.1 Products. We sell authentic eyewear sourced directly from the brands and their official ateliers. Each product is described as accurately as possible. Photographs and colours are for illustration; slight differences in shade or finish may occur depending on your screen and on the natural variations of materials such as acetate, horn or precious metals.

2.2 Availability. Our collection is sold simultaneously online and in our Liège boutique, and many pieces are rare or produced in very limited numbers. Stock shown on the Website is updated continuously but remains indicative. If an item you ordered turns out to be unavailable, we will inform you as soon as possible and refund the full amount paid within 14 days, without any further compensation being due.

2.3 Temporary holds. On request by email, we may hold an in-stock item for you for a limited period that we will confirm in writing. A hold is a courtesy: it does not create a contract, and the item is released automatically at the end of the period if no order has been placed.

2.4 Pre-orders. Some upcoming or rare pieces can be pre-ordered. Full payment is due when you place the pre-order, which secures your allocation. The delivery date given is an estimate based on the information provided by the brand. You may cancel a pre-order at any time before dispatch and receive a full refund. If the brand does not deliver the item, we will refund you in full.

Article 3 - Orders

3.1 Placing an order. You select your items, choose your delivery destination, check the summary of your order, including the total price, and confirm it with an obligation to pay. Before confirming, you can review and correct any errors in your order.

3.2 Formation of the contract. The contract is concluded when we send you an email confirming your order, after your payment has been authorised. Until then, we may decline an order for a legitimate reason.

3.3 Refusal and cancellation by us. We may refuse or cancel an order, and refund any amount paid in full, in particular:

  • in case of suspected fraud, unauthorised use of a payment method, or failure of the payment provider's security checks;
  • where the delivery address is incomplete, cannot be served by our carrier, or lies in a country subject to import restrictions;
  • where the product page contains an obvious error, such as a price manifestly out of proportion with the value of the item;
  • where the quantities ordered or the customer's order history suggest purchases for resale.

3.4 Records. Our electronic records of orders, payments and communications are kept securely and constitute proof of the transactions between you and us, unless you prove otherwise.

Article 4 - Prices and payment

4.1 Prices. Prices adjust automatically to your delivery destination:

  • Deliveries within the European Union: prices include Belgian VAT or, where applicable, the VAT of your country. No further taxes or duties are due on delivery.
  • Deliveries outside the European Union: prices are shown exclusive of VAT. Import duties, taxes and customs fees of the destination country are not included (see Article 6).

4.2 Delivery costs. Delivery costs, including preparation, packaging and shipping, are not included in the product price. They are calculated according to the destination and the parcel and shown at checkout, before you confirm your order.

4.3 Currency. Your order is processed in the currency corresponding to your delivery destination, as shown at checkout. Any conversion or foreign transaction fees charged by your bank are at your expense.

4.4 Final price. The total price shown when you confirm your order is the price you pay. It will not be changed after your order is confirmed.

4.5 Payment. Full payment is required when you place your order. Payments are processed by Shopify Payments and its partners; we never have access to your full card details. The payment methods available, such as credit and debit cards, digital wallets and local payment methods, depend on your country and device and are shown at checkout. All payments are subject to the security checks and authentication procedures of the payment provider.

Article 5 - Delivery

5.1 Carrier and destinations. We ship with DHL Express to most countries, subject to the carrier's service, import regulations and any restrictions imposed by local authorities. Where available, an adult signature is required on delivery. You are responsible for providing a complete and accurate delivery address; additional costs caused by an incorrect address are at your expense.

5.2 Delivery times. Orders are normally dispatched within 1 to 2 working days after payment is validated, and you receive a DHL tracking link. Delivery times shown on the Website and at checkout are estimates. Unless another date has been agreed, we deliver within 30 days of the conclusion of the contract. If we fail to deliver in time, you may ask us to deliver within an additional reasonable period; if we still fail to do so, you may cancel the order and we will refund you in full. A delay caused by circumstances beyond our control (Article 11) does not by itself give rise to compensation.

5.3 Transfer of risk. The risk of loss or damage passes to you when you, or a person you designate other than the carrier, take physical possession of the parcel. If you instruct DHL to change the delivery conditions, for example to leave the parcel in a safe place or to release it without signature, the risk passes to you when the parcel is delivered as instructed.

5.4 Damaged or missing parcels. If a parcel arrives visibly damaged, tampered with or open, accept it only after asking the courier to note the damage, or refuse it, and take photos immediately. Please report any lost, damaged or incomplete delivery within 48 hours of the expected or recorded delivery, so that we can open an investigation with DHL in time. This does not limit your statutory rights.

Article 6 – Deliveries outside the European Union

6.1 Import charges. For deliveries outside the EU, you act as the importer. Import duties, taxes, customs clearance fees and any other charges levied by the destination country are your responsibility and are usually collected by DHL before or on delivery. We have no control over these charges and cannot predict their amount; we recommend checking with your local customs authority before ordering.

6.2 Refused or unclaimed parcels. If you refuse a parcel, do not pay the import charges or do not collect it, it will be returned to us. Once it is back in our possession, we will refund the price of the item, minus the return shipping costs, customs and clearance fees and any other charges invoiced to us for the failed delivery and the return.

Article 7 – Personalised lenses

7.1 Original lenses. Sunglasses are delivered with the original factory-fitted lenses of each brand, as described on the product page. We do not sell prescription lenses through the Website.

7.2 Custom work. On request, we can fit ZEISS lenses with a custom tint, gradient or coating, or prescription lenses based on a prescription from your ophthalmologist. Each request is handled separately by email: we confirm feasibility, price and lead time in a written quote, and the work starts only after you accept the quote and pay for it.

7.3 Your responsibility. You are responsible for the accuracy of the prescription and information you provide. We are not liable for an unsuitable result caused by inaccurate or outdated information.

7.4 No withdrawal. Lenses made to your specifications are personalised goods. Once the work has started, they cannot be cancelled and are excluded from the right of withdrawal. The frame and lenses remain covered by the legal guarantee (Article 9).

Article 8 - Right of withdrawal

8.1 Principle. If you are a consumer, you may withdraw from your purchase without giving any reason within 14 days of receiving the item, by sending us a clear statement by email to contact@lebaralunettes-shop.com. You must then send the item back within 14 days of that statement.

8.2 Conditions and costs. Return costs are at your expense. If the item has been handled beyond what is necessary to establish its nature, characteristics and functioning, we will deduct the resulting loss in value from your refund, up to the full price if it can no longer be sold as new. Customs and clearance fees charged on returns from outside the EU are at your expense and deducted from your refund.

8.3 Exclusions. The right of withdrawal does not apply to personalised goods (Article 7) or to purchases by professional buyers.

8.4 Refund. We refund you within 14 days of receiving your withdrawal statement. We may withhold the refund until we have received the item back or you have provided proof of shipment, whichever comes first. For customers in the European Union, we prefer to refund by bank transfer with your agreement; otherwise, the refund is made using the payment method of your original purchase, in the currency of that payment. The deductions set out in Article 8.2 and in our Return & Refund Policy are applied to the amount refunded. If you return only part of an order, the original delivery costs are not refunded.

8.5 Full details. The procedure, deadlines, refund conditions and the model withdrawal form are set out in our Return & Refund Policy, which forms part of these Terms.

Article 9 – Legal guarantee of conformity

9.1 Scope. In accordance with Belgian and European consumer law, our products are covered by a legal guarantee of conformity for 2 years from delivery, for any lack of conformity existing at the time of delivery, such as manufacturing or material defects.

9.2 Exclusions. The guarantee does not cover normal wear and tear, accidental damage, damage caused by improper care or use, exposure to extreme heat, or any modification, adjustment or lens fitting carried out by a third party.

9.3 Notification. You must inform us of any lack of conformity as soon as possible, and in any event within 2 months of discovering it, by email to contact@lebaralunettes-shop.com, with your order number, a description and photos of the defect. Please do not send the item back before we have confirmed the procedure.

9.4 Remedies. We will first repair or replace the item, depending on what is possible and proportionate. Where neither is possible, you are entitled to the other remedies provided by law.

9.5 Brand services. Some brands offer additional services or commercial warranties. Where available, we will relay your request to the brand; these services do not affect your legal guarantee.

Article 10 – Liability

10.1 We are liable for the proper performance of our obligations under these Terms. Our liability is limited to direct and foreseeable damage and, except where the law provides otherwise, may not exceed the price paid for the order concerned.

10.2 We are not liable for damage resulting from your own fault, including an incorrect delivery address, inaccurate prescription data, improper use or care of the product, or changes you make to the delivery conditions with the carrier, nor for interruptions of the Website caused by technical maintenance or failures beyond our control.

10.3 Nothing in these Terms limits or excludes our liability for death or personal injury, for fraud, intentional misconduct or gross negligence, or any liability that cannot be limited under mandatory law.

Article 11 – Force majeure

We are not liable for any failure or delay in performing our obligations caused by events beyond our reasonable control, such as natural disasters, extreme weather, epidemics, war, civil unrest, strikes, transport disruptions, customs procedures, governmental measures or failures of our suppliers or carriers. We will inform you as soon as possible. If the event lasts more than 60 days, we may first offer you a new delivery date or a similar item of equivalent value; if you do not accept, either party may cancel the order concerned without compensation, and any amount paid for undelivered items will be refunded.

Article 12 – Personal data

We process your personal data in accordance with the General Data Protection Regulation (GDPR). Details on the data we collect, why we use it, who receives it and your rights are set out in our Privacy Policy.

Article 13 – Intellectual property

All content of the Website, including texts, photographs, videos, graphics, logos and its layout, is protected by intellectual property rights belonging to us or to the brands we represent. Any reproduction, use or distribution, in whole or in part, without our prior written consent is prohibited. Brand names and logos remain the property of their respective owners.

Article 14 – Complaints, disputes and applicable law

14.1 Complaints. Please send any complaint to contact@lebaralunettes-shop.com. We will do our best to find an amicable solution quickly.

14.2 Mediation. If no solution is found, consumers may contact the Belgian Consumer Mediation Service (Service de Médiation pour le Consommateur), North Gate, Boulevard du Roi Albert II 8 box 1, 1000 Brussels – https://mediationconsommateur.be.

14.3 Applicable law. These Terms and all sales made on the Website are governed by Belgian law. If you are a consumer residing in another country, this choice does not deprive you of the protection of the mandatory provisions of the law of your country of residence.

14.4 Jurisdiction. Any dispute with a professional buyer falls within the exclusive jurisdiction of the courts of Liège, Belgium. Consumers may bring proceedings before the courts of Liège or of their place of residence, and may only be sued before the courts of their place of residence, in accordance with applicable law.

14.5 Severability. If any provision of these Terms is held invalid or unenforceable, the remaining provisions remain in full force, and the invalid provision will be replaced by a valid one as close as possible to its original purpose.
